How Orniqa and this website handle your information, with app-specific details below.

This Privacy Policy applies to the Bird Sound Identifier — Orniqa mobile application published by Kiryl Nazarau (the “App”) and to this website. It follows the general privacy policy for our applications, with details specific to Orniqa.

Not every feature or service described below is present in every version of the App. A disclosure applies only when the relevant feature is present in the App you use.

1. Who is responsible

Kiryl Nazarau is the developer and data controller responsible for the App covered by this policy. Contact details are provided at the end of this page.

2. Information we process

The information processed depends on the features you choose to use.

Content you provide

  • Photos, images, camera input, audio recordings, text, notes, collection records, and other content you choose to import, create, scan, or analyze.
  • Feedback, support messages, and information you send when contacting us.
  • Optional location information when a location-based feature is enabled and you grant permission.

App, device, and diagnostic information

  • App version, device and operating-system information, language, country or general region, feature interactions, crash reports, diagnostics, and performance information.
  • Random installation or account identifiers used by the App or a service provider to operate purchases, subscriptions, analytics, attribution, fraud prevention, or cloud synchronization.
  • Purchase and subscription status. Payment card details are processed by Apple and are not provided to us.

Advertising and attribution information

The App may include advertising, analytics, or attribution services. Where Apple’s App Tracking Transparency rules apply, the App requests your permission before accessing the advertising identifier or tracking your activity across other companies’ apps and websites. You may change tracking permission in iOS Settings.

Permissions

The App may request access to the camera, photo library, microphone, location, motion and fitness data, notifications, or iCloud only when needed for a feature you select. You can manage permissions in iOS Settings. Denying a permission may prevent the related feature from working but does not prevent use of unrelated features.

3. How and why we use information

We use information only as needed to:

  • provide requested App features, including identification, scanning, analysis, search, exports, and cloud synchronization;
  • save your preferences and content locally or in your personal iCloud container where supported;
  • validate purchases, manage subscriptions, restore entitlements, and prevent fraud or abuse;
  • diagnose crashes, maintain security, measure performance, and improve reliability;
  • provide support and respond to your requests;
  • show and measure advertising where the App includes ads, subject to consent and platform controls; and
  • comply with applicable law and protect our users, services, and legal rights.

Depending on your location and the processing involved, our legal bases may be performance of a contract (providing the App feature you request), your consent, our legitimate interests in security and product operation, and compliance with legal obligations. You may withdraw consent at any time without affecting processing already performed.

4. Local storage and iCloud

The App stores preferences, saved items, and generated output on your device. Removing the App may remove locally stored data unless iOS retains it through offloading, a device backup, an export, or cloud synchronization.

Where the App offers iCloud or CloudKit synchronization, data is stored using your Apple account and Apple’s infrastructure. Private CloudKit data is associated with your iCloud account and is used to synchronize your devices. You can manage iCloud access in iOS Settings and may be able to delete data inside the App or through Apple’s account and storage controls.

5. AI and remote processing

Some features require server-side processing. When you intentionally use such a feature, the App may securely transmit the selected photo, audio, text, or other input to our server or a listed service provider to produce the requested result. We do not use content submitted to our own servers to train advertising profiles. A third-party provider processes information under its own terms and privacy commitments, and retention may vary by provider and configuration.

AI-generated identifications, descriptions, estimates, and other results may be inaccurate and should not be treated as professional, medical, legal, financial, or safety advice.

6. Service providers and external sources

We may share only the information reasonably necessary to operate a feature with the providers below. The exact providers depend on the App version and configuration.

  • Apple — App Store distribution and payments, StoreKit, iCloud/CloudKit, device services, and App Attest. Privacy Policy

We may also disclose information if required by law, to protect safety or legal rights, or as part of a business transfer. We do not sell your personal content. We do not permit service providers to use information supplied by us for their own unrelated advertising purposes.

7. App-specific information: Orniqa

Orniqa does not contain third-party advertising and does not request permission to track you across other companies’ apps and websites.

Sound identification

When you use Sound ID, the audio recording is sent over an encrypted connection to our identification server and analyzed with a bird-sound model based on Google Perch. The temporary server copy is deleted after the request is processed. We do not use the recording for advertising, profiling, or model training.

Location and Explore

If you grant location permission, Orniqa may attach approximate coordinates to an identification or sighting and use them to show nearby observations and species. Explore may request public biodiversity data from GBIF or similar listed sources. Location access is optional and can be disabled in iOS Settings.

Photo identification and descriptions

When you choose Photo ID, a compressed version of the selected image may be transmitted through AIProxy to OpenAI for analysis. Species names or identification results may also be sent to generate an explanatory description. Do not submit images containing information you do not want processed for this purpose.

Life List and recordings

Your saved birds, sightings, and retained recordings are stored on your device and, when iCloud synchronization is enabled, in your private CloudKit database. Orniqa provides controls to export or delete supported data. You can also manage the App’s iCloud access in iOS Settings.

Subscriptions and abuse prevention

Apple processes payments. RevenueCat receives purchase and entitlement information needed to activate and restore Orniqa Pro; it does not receive your payment card number. App Attest may be used to verify that requests come from a genuine App installation. For this purpose our server may retain an attestation key identifier, environment, request counter, and validation metadata to prevent misuse.

8. Retention and deletion

We retain personal information only for as long as needed for the purpose described in this policy, to provide an active service or subscription, maintain security, resolve disputes, and meet legal obligations. Retention differs by data type:

  • local content remains until you delete it or remove the App, subject to device backups and offloading;
  • cloud content remains until deleted through the App, your cloud account, or a supported deletion request;
  • diagnostic, subscription, attribution, and security records are retained according to operational need and the relevant provider’s retention settings; and
  • temporary processing files are deleted when no longer needed to return the requested result.

To request access to or deletion of information controlled by us, email us with the App name and enough detail to locate the relevant record. We may need to verify your request. For data controlled directly by Apple or another provider, you may also need to use that provider’s privacy controls.

9. Security and international processing

We use reasonable technical and organizational safeguards, including encrypted network connections for supported remote features. No storage or transmission method is completely secure, so we cannot guarantee absolute security.

Our providers may process information in countries other than your own. Where required, we and our providers rely on recognized transfer mechanisms and contractual safeguards for international transfers.

10. Children

The App is not directed to children under 13, and we do not knowingly collect personal information from children under 13. In regions with a higher digital-consent age, a child should use features involving personal information only with authorization from a parent or guardian. Contact us if you believe a child has provided personal information so we can review and delete it where appropriate.

11. Your privacy rights

EEA, United Kingdom, and similar jurisdictions

Depending on applicable law, you may have rights to access, correct, delete, restrict, or object to processing; receive a portable copy; withdraw consent; and lodge a complaint with your local data protection authority. Where processing is based on legitimate interests, you may object based on your circumstances.

United States

Depending on your state, you may have rights to know, access, correct, delete, or obtain a copy of personal information and to opt out of sale, targeted advertising, or certain sharing. We do not sell personal content. Where the App uses advertising or attribution, platform privacy settings, consent controls, and App Tracking Transparency provide relevant choices. We will not discriminate against you for exercising an applicable privacy right.

You may submit a request using the email below. If we deny a request, you may appeal by replying to our decision and stating that you wish to appeal.

12. Changes to this policy

We may update this policy when App features, providers, or legal requirements change. The effective date at the top identifies the latest version. Material changes may also be communicated in the App or through another appropriate notice.
